A Kenyan court has sentenced Jacktone Odhiambo, a 25-year-old photographer, to 50 years in prison for the brutal murder of his housemate, Edwin Kiprotich Kipruto, popularly known as Edwin Chiloba. The sentencing, delivered by Judge Reuben Nyakundi, cited the "diabolical manner" of the killing as a significant factor in determining the length of the prison term. The murder, which took place in early January 2023, sent shockwaves across Kenya, particularly within the LGBTQ+ community, as Chiloba was a well-known LGBTQ+ activist and fashion designer.
Edwin Chiloba’s death was a grim event that underscored ongoing concerns about violence against LGBTQ+ individuals in Kenya. Chiloba, a 25-year-old fashion student at the University of Eldoret and a vibrant advocate for equality and self-expression, was smothered to death before his body was dumped in a metal box along a roadside in Eldoret. Post-mortem results revealed that Chiloba died of asphyxiation caused by smothering, with his body discovered with socks stuffed into his mouth and a piece of denim tied tightly around his face. These harrowing details emphasized the deliberate and brutal nature of the crime.
The prosecution, led by Mark Mugun, presented compelling evidence during the trial, including testimonies from 23 witnesses and DNA tests linking Odhiambo to the crime scene. Prosecutors also argued that Odhiambo had stolen and splurged Chiloba’s money following the murder, painting a picture of betrayal and vengeful intent. While speculation arose about the nature of the relationship between the two men, with some reports suggesting they were romantically involved, the court refrained from making any specific findings regarding the motive behind the killing.
Judge Nyakundi described Odhiambo as showing no remorse for his actions throughout the trial. However, after the verdict was read, Odhiambo caused a stir in the courtroom by collapsing to the floor in tears, a stark contrast to his earlier demeanor. The judge emphasized that the act was premeditated, brutal, and unforgivable, leading to a sentence designed to reflect the severity of the crime. “I have considered all factors and found that Odhiambo was a vengeful person who committed the killing of his close friend,” Justice Nyakundi stated during sentencing.
The tragic murder of Edwin Chiloba drew widespread condemnation both locally and internationally, shining a spotlight on the violence and discrimination faced by LGBTQ+ individuals in Kenya. Chiloba was admired for his outspoken advocacy and his efforts to champion equality and acceptance, despite living in a conservative society where homosexuality remains highly stigmatized and criminalized under colonial-era laws. His death sparked discussions on LGBTQ+ safety and rights in the country, prompting calls for legal reforms and greater protections for marginalized communities.
While the sentencing marks the end of a harrowing legal process, it serves as a sobering reminder of the risks faced by LGBTQ+ individuals in Kenya and beyond. Chiloba’s life and work remain an enduring symbol of resilience and self-expression, inspiring many to continue advocating for a more inclusive and tolerant society. The court’s decision, though delivering justice, also underscores the need for societal change to prevent such tragic incidents in the future. For many, Edwin Chiloba’s legacy will live on as a beacon of courage in the face of adversity.
